U.S. District Judge Gladys Kessler denied a motion for dismissal by the tobacco companies, rejecting their argument that the case violated the U.S. Constitution's separation of powers among the executive, judicial and legislative branches of government.
The U.S. government has brought the racketeering claims against the Philip Morris unit of Altria Group Inc., R.J. Reynolds Tobacco Holdings Inc., the Loews Corp.'s Lorillard Tobacco unit, British American Tobacco Plc, Brown & Williamson Tobacco Co. and the Vector Group Ltd.'s Liggett Group.
The suit seeks $289 billion in damages and tougher rules on marketing, advertising and warning claims on tobacco products.
