A Family Law Court judge has restricted a mother's smoking in her home to protect
her 10-year-old son from second-hand cigarette smoke.
The ruling, believed to be the first of its kind in Australia, was hailed by the anti-smoking lobby yesterday but civil libertarians raised concerns about judicial intrusion into parenting decisions.
The boy's father took the case to the court in Perth after his son complained that he did not want to return to his mother's home, where she and his grandfather were heavy smokers. . .
