Marquez hopes his claim that he contracted cancer from secondhand smoke at
Rikers Island will pay off.
Marquez, 75, got a break yesterday when Manhattan Supreme Court Justice Michael Stallman refused to throw out his $15 million suit.
Marquez spent 29 months at Rikers between 1998 and 2001 while awaiting trial on gambling charges. He was diagnosed with bladder cancer in September 2000, and was acquitted of the criminal charges in July 2001.
"How does the city even have the audacity to argue against this case when after I filed suit they banned smoking at Rikers?" noted Marquez's son, David Marquez, who is his attorney.
Smoking was banned at Rikers in March 2003.
