Oskkosh, WI Bans Smoking in Restaurants [04/09-5]

Oshkosh is soon to become Wisconsin’s toughest cop on restaurant smoking, and the clock is ticking for restaurants to comply.
Some are jubilant. Others are irate. And the losers are talking about challenging the results of Tuesday’s competing smoking ban referendums. City voters narrowly approved a city referendum Tuesday instituting the state’s most inclusive restaurant smoking ban to date. It bans smoking in any establishment with more than 30 percent of its annual sales coming from food. The opposite, an establishment where more than 70 percent of sales come from alcohol, is deemed a “tavern,” exempt from the ban.
The ban was approved with 6,307 votes in favor and 6,123 against.
Breathe Free Oshkosh’s ordinance will now require affected restaurants to comply with the ban within 10 days. The city will likely have to play some catch-up.
First, the health department will fire off a round of notices to more than 200 establishments seeking financial disclosures either including or exempting them from the ban.
Restaurants with full-service bars will be able to completely enclose them, provided they are separately ventilated. That, and only that, will allow indoor smoking at restaurants.
